CHARTER OF BIRDAMLIK PEOPLE’S DEMOCRATIC PARTY OF UBZEKISTAN

1.    GENERAL PROVISIONS

 

1.1. Birdamlik People’s Democratic Party of Uzbekistan  (abbreviated name BPDPU) is an association of citizens of our country, of all the citizens of our country who have to live in very difficult conditions, who are forced to look for work and quiet life in different countries because of oppression of the dictator and his dictatorship regime, repressions, because of violation of human rights, lack of social protection, and conducts its activities to implement the purposes and objectives set out in the Program of the organization.

1.2. The party conducts its activities throughout the territory of Uzbekistan and Karakalpakstan and in foreign countries.

1.3. The management bodies (offices) of the party will be organised in Tashkent city, region  and district centres, also in foreign countries.

1.4. The party will conduct its activities in accordance with the Constitution of Uzbekistan, the Universal Declaration of Human Rights and other existing laws of the country, the Program of the People’s Democratic Party Birdamlik and this Charter.

1.5. After state registration in the established order, the Party will have the status of a legal entity (de jure), and will have the right to own property, an independent accounting balance, to open settlement and other accounts at banks.

2. PURPOSES AND OBJECTIVES

2.1. The strategic purposes of the Party: establishment of free and prosperous Uzbekistan, based on government by people and human rights, creation of a democratic, free society, constitutional state based on private property.

2.2. An important task of the Party to achieve its goals is organization of struggle for life, rights, honour, and freedoms of the people by using their constitutional rights!

3.    MEMBERSHIP

3.1. Membership conditions: Citizens of the following categories can become members of Birdamlik PDP:

a) citizens of Uzbekistan who have reached the age of 18;

b) all persons, irrespective of their gender, secular or religious beliefs, race, nationality, who have accepted the Program and Charter of Birdamlik People’s Democratic Party and have been active in implementation of its rules:

c) The persons, who have been members of the Birdamlik People’s Democratic Movement and who were able to participate at its congress until establishment of the Party will retain their membership in the Party.

4. Rights and tasks of party members:

4.1. Members of the Party shall have equal rights.

4.2. They can participate at events, held by the Party, elect and be elected to the governing bodies of the Party;

5. Obligations of the members of the Party

a) fulfilment of the requirements of the approved Program and this Charter;

b) Fulfilment of decisions of the governing bodies and instructions of the party management.

5.1. Timely payment of membership fees, established by the Central Committee of the Party;

5.2. Joining the party shall be possible in primary groups in makhallas, in district, town, and  region  organizations.

5.3. A member of a party may conduct activities that do not contradict the purposes and objectives of the party in the other public organizations.

5.4. Persons who have grossly violated the terms of this Charter or have committed crimes that defame the ideological and moral foundations of the Party shall be excluded from the organization.

5.5. The decision on exclusion from the Party shall be taken by local departments, primary groups and approved by the Central Committee.

6. ORGANIZATIONAL STRUCTURE

6.1. According to its organisational structure, the Party will conduct its activities as a system that consists of Congress, the Central Committee (CC), the Management Board (MB), the chairman, oblast, town, district councils, primary groups of sections and cells, and management shall be run on the basis of this hierarchy.

6.2. A cell shall be the primary group of the Party and will consist of three (3) to ten (10) people.

6.3. A section shall be the second primary group of the Party and will consist of eleven (11) and more members.

6.4. The primary groups of the party – cells and branches shall be parts of district and city councils.

6.5. The district and town councils of the Party shall be parts of region  councils of the Party.

6.6. Region, town and district councils shall delegate their representatives to meetings, conferences, Congresses (or by means of communication via the Internet), and participate in discussions of important issues, documents and decision-making.

6.7. The region councils of the Party shall be part of the Republican Council of Uzbekistan, and will conduct their activities under the management of the Republican Council.

6.8. Primary, district, town and region sections-councils of the Party shall be organised in the neighbouring countries and far abroad, which will conduct their activities as part of the republican organisation in a particular country.

6.9. Representatives of oblast, town, and district councils, delegated to meetings, conferences, and congresses and those of such participating through the Internet shall have equal rights and duties.

7. REGION  COUNCILS

7.1. Region councils, and societies outside Uzbekistan, shall be integral parts of the Party;

7.2. The composition and organisational structure of region  councils, management bodies shall be determined by this Charter, approved by the Central Committee of the Party;

7.3. Termination of the activities of region councils shall be effected by the decision of the Central Committee of the Party.

7.4. Region councils and societies outside the country shall report to the Central Committee and the Management Board of the Party.

8. Management of activities of the Party

8.1. The supreme executive meeting of the Party Congress shall be convened once every four (4) years and shall be called the Supreme Assembly.

8.2. In the period between congresses, the activities of the party shall be carried out by the Central Committee elected by the Supreme Assembly, the Management Board and the Chairman of the party.

8.3. The leader of the party – the Chairman shall have the authority to manage the Party and act on its behalf and shall be elected by the congress for a term of four (4) years.

8.4. The Management Board of the Party shall be the supreme political and organisational-governing body of the Party after its Central Committee.

8.5. An extraordinary congress of the Party may be called by decisions of the Central Committee or at the request of at least two-thirds of region councils.

8.6. The procedure for electing delegates to the next congress shall be established by the Central Committee of the Party.

8.7. Issues in exclusive competence of the Congress:

a) Adoption and approval of the Program and the Charter, introducing changes and supplements to such in the established order;

b) Approval or refusal to approve of program documents proposed by the Central Committee;

c) The Central Committee and the Management Board of the Party shall be elected for a four years term.

d) the Chairman of the Party may hear the report of the Central Committee and approve it or refuse to approve it;

f) Making decisions on disputed issues in the activities of the Party.

8.8. The quorum of the Party Congress shall be considered achieved at participation of two thirds of the representatives, elected to participate in the Congress.

8.9. The order of voting on all issues shall be established during the Congress.

8.10. The Chairman of the Party shall have the right to establish communications and carry out negotiations in international arena, with government bodies, public organisations, and movements;

8.11. The Chairman of the Party shall organise the work of the Congress, the Central Committee and the Management Board;

8.12. The Chairman of the Party shall sign the decisions and statements adopted by the Congress, the Central Committee, and Management Board.

8.13. The Chairman of the Party shall be the responsible manager who is accountable to the Congress, the Central Committee, and the Management Board.

8.14. In the event of impossibility for the Chairman of the Party to fulfil his/her duties, prior to the calling an extraordinary Congress, at the initiative of the Management Board, the Central Committee shall elect a Temporary Acting Chairman or Temporary Acting Co-Chairmen.

9. CENTRAL COMMITTEE (CC)

9.1. The Central Committee (CC) shall be a permanently functioning body of the Party. The congress shall elect one or two (1-2) people from each region council of Uzbekistan and the Republic of Karakalpakstan, from each organization, Party branch in foreign countries to the Central Committee.

9.2. Meetings of the Central Committee of the Party shall be held once every three (3) months by direct participation or via the Internet, or, if necessary, such meetings are held as extraordinary meetings.

9.3. The quorum of meetings of the Central Committee shall be considered achieved at participation of more than half of its members. Decisions shall be made by simple majority of votes.

9.4. Rights of the Central Committee:

a) Approvals of annual revenues and losses of the Party;

b) Making decisions on convening the next or extraordinary Congress of the Party and determining the number of representatives;

c) The Central Committee may change composition, the increase in the number of its members through the admission of new members and this quantitative composition should not be more than 51 members, the number of which is limited by the Congress.

d) The Central Committee shall have the rights to conduct activities of a legal entity on behalf of the Party and fulfil its obligations in accordance with this Charter and existing legislation of the country.

e) The Central Committee shall address the issues that are not included in the authorities of the Congress and specified in this Charter.

f) Shall conduct management activities that do not contradict with the party’s program documents, and contribute to successful implementation of the purposes and objectives set by the Party.

g) Shall determine the amounts of monthly membership dues of the members of the Central Committee and ordinary members of the Party and control their payment.

h) The decision on whether or not join the electoral blocs of certain parties during electoral campaigns for the Parliament and election of the President of Uzbekistan.

9.5. The number of members of the Central Committee should not be less than twenty one (21) and more than fifty one (51) people.

9.6. Upon necessity, the Central Committee may expand the number of its members to 51 members and accept a new member (co-optation) to its composition.

9.7. Based on unanimous, general approval and recommendations of the Central Committee, the co-opted member and the members elected at the Congress shall have equal rights and obligations.

10. MANAGEMENT BOARD (BOARD)

10.1. The Management Board shall be elected at the Congress from among the members of the Central Committee and conduct direct management in implementation of the purposes and objectives of the Programme under the leadership of the Chairman of the Party.

10.2. The Management Board shall be the governing body that carries out regular political and organisational work between meetings of the Central Committee of the Party.

10.3. The Management Board shall organise and coordinate the activities of oblast, town and district offices of the Party in Uzbekistan and abroad.

10.4. The meetings of the Management Board shall be held at least once a month in the form of a Conference by way of personal participation or via the Internet.

10.5. Based on majority approval and recommendations, Management Board may, if necessary, accept a new member (co-optation).

10.6. Based on unanimous, universal approval and recommendations of the Management Board, the co-opted member of the Management Board and members elected at the Congress have equal rights.

10.7. The Management Board shall provide management and ensure implementation of political, mass-public, socio-cultural events and political-theoretical studies.

11. FUNDING AND ECONOMIC ISSUES

11.1. The members and the head of the Central Financial and Economic Group within the Central Committee of the Party shall be elected for a 2 years term, and conduct its activities on the basis of the Program and this Charter;

11.2. The Central Financial and Economic Group shall carry out all work related to financing, property and economy in the framework of the activities on financing and representing the interests of the organization indicated in the Program and Charter:

a) shall organise the work of and finances exhibitions, publications, training seminars;

b) shall acquire property in the interests of the Party;

c) shall carry out search for sources of financing and conduct charitable activities.

11.2. Financial sources of the Party shall be made up from:

a) membership fees, voluntary payments, income from entrepreneurship activities;

b) voluntary material assistance and donations from legal entities and individuals, and sponsors:

c) funds from events held by the Party;

d) other financial sources not prohibited by law.

11.3. Funds shall be spent on the basis of the goals and objectives of the Party.

11.4. Revenues from activities of members of the Party shall be spent for achieving the purposes and objectives of the Party.

12. SUPERVISORY-AUDITING GROUP

12.1. The members and the head of the Supervisory-Auditing Group of the Party shall be elected for a two-year term at a meeting of the Central Committee, and conduct their activities on the basis of the Program and Charter.

12.2. Authorities of the Supervisory Auditing Group:

a) Control over the financial and economic activities of the Party;

b) Submit to the Central Committee a report on financial and economic activities and financial discipline.

12.3. The Governing Board may not be part of the Supervisory Audit Group.

12.4. Decisions of meetings of the Supervisory Audit Commission shall be considered valid when more than half of its members participate at the meeting. Decisions shall be made by simple majority of votes.

13. Amendments and additions to the Charter of the Party

13.1. At recommendation of the Central Committee and the Management Board, supplements and changes to the Charter of the Party shall be introduced by majority votes of the Congress.

14. Reorganization and termination of the party

14.1. The activities of the Party may be terminated by own decision of the Congress or by a court decision in accordance with the legislation of Uzbekistan.

14.2. The decision on reorganization or liquidation of the Party shall be considered valid when two thirds of the votes of the representatives of the Congress are given

 The Charter of the People’s Democratic Party of Uzbekistan “Birdamlik” was adopted at the congress on November 15, 2018.
